Terms and Conditions

These Terms and Conditions ("Terms") govern your purchase of tickets to and attendance at Sleep Summit 2026 (the "Event"), produced by Marks Media LLC, a Delaware limited liability company doing business as "The FAM" ("Organizer," "we," "us," or "our"). By purchasing a ticket, registering for, or attending the Event in any capacity (including general admission or VIP), you ("you" or "Attendee") agree to be bound by these Terms.

If you do not agree to these Terms, do not purchase a ticket or attend the Event.

Event Overview

1.1 Event Dates and Location.

Sleep Summit 2026 is currently scheduled to take place October 6–9, 2026 in Bentonville, Arkansas.

1.2 General Event Structure.

The Event is expected to include, among other things:

  • A welcome happy hour on October 6, 2026;
  • Conference sessions on October 7–8, 2026, including scheduled breakfast and lunch service windows;
  • A wrap party with live entertainment on the evening of October 8, 2026;
  • Optional, informal "bonus day" activities on October 9, 2026, including a mountain biking experience and a visit to Crystal Bridges Museum of American Art.

1.3 Event Theme and Focus.

The Event theme is "Find Your Groove", with programming focused on helping attendees find their groove in business, marketing, operations, AI, company culture, and the evolving mattress/sleep industry.

1.4 Right to Modify.

Organizer reserves the right, in its sole discretion, to modify the Event format, schedule, speakers, locations, activities, or offerings at any time, for any reason, without liability to you.

Ticket Types, Pricing, and Payment

2.1 Ticket Types.

  • General Admission (e.g., retailer vs. non‑retailer/manufacturer categories as described at checkout);
  • VIP Tickets, which provide additional access and experiences beyond General Admission, as outlined in Section 3 and the Event website.

2.2 Standard VIP Pricing (Non‑Promotional).

VIP – RetailerUSD $1,599
VIP – Manufacturer / Non‑RetailerUSD $1,999

2.3 Early Bird VIP Pricing.

During the Early Bird Special period, VIP pricing is reduced as follows:

VIP – RetailerUSD $1,449
VIP – Manufacturer / Non‑RetailerUSD $1,749

The Early Bird Special runs from May 1, 2026 through May 31, 2026. After May 31, 2026, prices revert to the standard VIP pricing set out above.

2.4 General Admission Pricing.

General Admission ticket types and pricing will be described on the Event sales page and checkout flow. Organizer may adjust General Admission prices at any time prior to purchase.

2.5 Currency and Payment.

All ticket prices are in U.S. dollars unless otherwise stated and must be paid in full at the time of purchase. Your ticket is not confirmed until payment has been successfully processed and you receive a confirmation from Organizer or its ticketing provider.

2.6 Changes to Pricing.

Organizer may introduce new ticket types, adjust pricing, or run promotions at any time prior to your purchase. Pricing changes will not affect tickets already purchased.

What's Included with Each Ticket Type

3.1 General Admission Includes:

  • The welcome happy hour on October 6, 2026;
  • Access to all event sessions on October 7 and 8, 2026;
  • Access to the wrap party on the evening of October 8, 2026.

3.2 VIP Includes (in addition to all General Admission benefits):

  • The welcome cocktail party;
  • Breakfast on both main event days (October 7 and 8, 2026) from 7:30 a.m. to 8:30 a.m. at the Compton Hotel;
  • A VIP dinner plus VIP cocktail hour, including an exclusive VIP-only experience on the evening of October 7, 2026;
  • Lunch on both main event days, from 12:00 p.m. to 1:30 p.m.;
  • Access to the wrap party on October 8, 2026, with doors opening at 7:00 p.m. and music starting at 8:00 p.m.;
  • Other potential bonus perks or surprises that Organizer may add for VIP Attendees, at Organizer's sole discretion.

3.3 Schedule Notes (Illustrative).

  • Breakfast: 7:30–8:30 a.m. at the Compton Hotel;
  • Sessions: starting at 9:00 a.m.;
  • Lunch: 12:00–1:30 p.m.;
  • Afternoon sessions: resuming at 1:30 p.m. and concluding approximately 3:30–4:00 p.m.

Optional Bonus Day (October 9, 2026)

4.1 Nature of Bonus Day.

On October 9, 2026, Organizer intends to facilitate an informal, optional bonus day in Bentonville, Arkansas. Planned activities may include a mountain biking experience departing at approximately 10:30 a.m., a visit to Crystal Bridges Museum of American Art, and a post‑activity meet‑up between approximately 12:30 and 1:00 p.m.

4.2 Attendee Responsibility for Costs.

The bonus day is informal and optional. Attendees are solely responsible for their own hotel costs, food and beverage, bike rentals, museum tickets, transportation, or other activity fees.

4.3 Third‑Party Providers.

Some or all bonus day activities may be operated by third‑party providers. Organizer is not responsible for such third‑party services and is not liable for any acts or omissions of those providers.

Refund, Cancellation, and Transfer Policy

5.1 All Sales Final; Non‑Refundable.

All ticket sales are final. Tickets are non‑refundable and non‑cancellable for any reason, including but not limited to:

  • Attendee illness, travel interruptions, or scheduling conflicts;
  • Dissatisfaction with the Event content, programming, or changes to the schedule;
  • Changes to speakers, venues, or ancillary activities.

5.2 Ticket Transfers.

  • Tickets may be transferred to another individual at Organizer's discretion.
  • VIP tickets must be transferred at least fourteen (14) days prior to the Event start date (currently October 6, 2026). Transfers requested after this time may be denied.
  • Organizer does not charge a transfer fee at this time, but reserves the right to implement such a fee in the future.

5.3 No Credits to Future Events (Except at Organizer's Discretion).

Organizer does not offer credits to future events as a standard policy. Any credit or accommodation for future events will be at the sole discretion of The FAM and must be confirmed in writing.

5.4 Changes or Cancellation by Organizer.

Organizer may reschedule, modify, or cancel the Event in whole or in part. In the event of a full cancellation, Organizer may, at its sole discretion, offer a limited refund and/or credit. Any such remedy will be your sole and exclusive remedy.

Assumption of Risk; Release of Liability; Covenant Not to Sue

6.1 Inherent Risks.

You understand that attending and participating in the Event and related activities involves inherent risks, including but not limited to:

  • Personal injury, illness, or death;
  • Property damage or loss;
  • Accidents during travel, at venues, or during recreational activities;
  • Exposure to infectious diseases;
  • Risks associated with the consumption of food, beverages, and alcohol;
  • Risks associated with large gatherings and live entertainment.

6.2 Assumption of Risk.

By purchasing a ticket and/or attending the Event, you voluntarily assume all risks associated with your attendance and participation, whether or not such risks are described in these Terms.

6.3 Release of Liability.

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Marks Media LLC, its members, managers, officers, employees, agents, contractors, sponsors, partners, venue owners and operators, and their respective successors and assigns (collectively, "Released Parties") from any and all claims, demands, losses, damages, costs, and liabilities of any kind, whether known or unknown, arising out of or relating to your attendance at or participation in the Event or any related activities, including but not limited to personal injury, death, property damage, or loss.

6.4 Indemnification.

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your attendance at the Event, or your conduct at or in connection with the Event.

Code of Conduct

7.1 Expected Behavior.

All attendees are expected to:

  • Treat all participants, staff, speakers, and venue personnel with respect and professionalism;
  • Refrain from harassment, discrimination, or disruptive behavior of any kind;
  • Comply with all venue rules and applicable laws;
  • Consume alcohol responsibly, if at all.

7.2 Removal.

Organizer reserves the right to remove any attendee from the Event, without refund, whose behavior in Organizer's sole judgment: violates these Terms or venue policies; or interferes with the safety or enjoyment of other attendees, staff, or participants.

8

Health and Safety

8.1 Attendee Responsibility.

You are responsible for your own health and safety at the Event. You represent that you are in adequate physical condition to participate in all activities you choose to attend, including optional recreational activities such as mountain biking.

8.2 Health Requirements.

Organizer may implement health and safety protocols at any time, including but not limited to requirements related to vaccination, testing, masking, or other public health measures. You agree to comply with any such protocols as a condition of attendance.

Travel, Accommodation, and Third‑Party Services

9.1 Attendee Responsibility.

Unless expressly stated otherwise in writing, you are solely responsible for arranging and paying for your travel, lodging, and incidental expenses in connection with attending the Event.

9.2 Third‑Party Providers.

Organizer may provide information about or facilitate reservations with third‑party providers (e.g., hotels, transportation, restaurants, activity operators). Organizer is not responsible for and has no control over such third parties and is not liable for their acts or omissions.

Force Majeure

Organizer shall not be liable for any delay, modification, or failure to perform any obligation under these Terms due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, pandemics, public health emergencies, government orders, or failures of utilities or communications.

In such circumstances, Organizer may reschedule, modify, or cancel the Event. Any refund or credit, if offered, will be at Organizer's sole discretion and will be your exclusive remedy.

Intellectual Property; Recordings; Use of Likeness

11.1 Event Content.

All Event content—including presentations, slides, recordings, branding, logos, written materials, and other intellectual property—is owned by Organizer, the speakers, or their respective licensors. You may not record, reproduce, distribute, or exploit Event content, except for limited personal, non‑commercial use as reasonably permitted, without prior written consent.

11.2 Consent to Recording and Use of Likeness.

By attending the Event, you acknowledge and agree that:

  • Organizer and its partners may photograph, film, or otherwise record the Event, including attendees; and
  • Organizer may use your name, image, voice, likeness, and biography captured at or in connection with the Event in any media for any lawful purpose, including marketing, advertising, publicity, editorial, and promotional purposes, without compensation to you.

By checking the consent box at checkout and/or attending the Event, you expressly consent to such recording and use and waive any rights of privacy or publicity to the extent permitted by law.

Data Protection and Privacy

12.1 Privacy Policy.

Organizer's collection, use, and processing of personal data in connection with the Event is governed by our Privacy Policy, available at: https://thefam.com/sleep-summit-privacy-policy

By registering for and attending the Event, you acknowledge that you have reviewed and agree to the Privacy Policy.

12.2 Communications.

By purchasing a ticket, you consent to receive transactional and informational emails and other communications related to the Event. You may also receive marketing communications from Organizer, which you can opt out of as described in the Privacy Policy.

Dispute Resolution, Governing Law, and Limitation of Liability

13.1 Governing Law.

These Terms and any dispute arising out of or relating to the Event shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of laws principles.

13.2 Mandatory Arbitration.

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Event, or your attendance shall be resolved exclusively by binding arbitration administered by a recognized arbitration provider, in Benton County, Arkansas, before a single arbitrator. You and Organizer waive the right to a jury trial to the fullest extent permitted by law.

13.3 Class Action Waiver.

To the fullest extent permitted by law, you agree that any claims you bring must be brought in your individual capacity only, and not as a plaintiff or class member in any purported class, collective, representative, or mass action.

13.4 Limitation of Liability.

To the fullest extent permitted by law, the total aggregate liability of the Released Parties to you for any and all claims arising out of or relating to these Terms, the Event, or your attendance shall be limited to the amount you actually paid for your ticket. In no event shall the Released Parties be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages.

Miscellaneous

14.1 Severability.

If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

14.2 No Waiver.

No failure or delay by Organizer in exercising any right or remedy under these Terms shall be deemed a waiver of such right or remedy.

14.3 Entire Agreement.

These Terms, together with the Privacy Policy and any additional terms referenced at checkout or on the Event website, constitute the entire agreement between you and Organizer with respect to the Event.

14.4 Amendments.

Organizer may update or modify these Terms at any time. The version in effect at the time of your ticket purchase and/or attendance will govern your participation.

BY CHECKING THE BOX AT CHECKOUT AND COMPLETING YOUR TICKET PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING THE ASSUMPTION OF RISK, RELEASE, INDEMNIFICATION, MANDATORY ARBITRATION, AND CLASS ACTION WAIVER PROVISIONS ABOVE.
